EMPLOYER OPENING STATEMENT

The first step in the arbitration hearing is the opening statement of the employer. The person representing the employer will outline their case, their evidence, and witnesses they will present. They will also provide their reasons for choosing the disciplinary action. This is like a road map for the arbitration.

The second step of the arbitration hearing is the opening statement from the employee's side. The employee's representative will outline their case, the evidence, and witnesses they will present during the hearing. The employee's representative will also present suggestions for alternate/reduced disciplinary action.

EMPLOYER DIRECT EXAMINATION

The employer is the first party to present its witnesses during the arbitration hearing. When a party questions the witnesses they have provided, it is called direct examination.

UNION CROSS EXAMINATION

Once the employer has presented all of their witnesses, the opposing party has a chance to question the employer's witness. This is called cross examination. Cross examination occurs after direct examination.

UNION DIRECT EXAMINATION

After the employer has questioned all of it's own witnesses and the employee's side has cross examined the employer's witnesses - the employee's side will present their witnesses.  The employee side is the second party to present witnesses during the arbitration hearing. When a party questions the witness they provided, it is called direct examination.

EMPLOYER CROSS EXAMINATION

Once the employee's side has questioned all of its own witnesses, the employer's side will have the chance to question the employee's witness(es). This is called cross examination. Cross examination for the employer's side occurs after the employee's side has directly questioned all of its own witnesses.

ER CLOSING STATEMENT

EMPLOYER CLOSING STATEMENT

After all of the witnesses for the employee have been cross examined by the employer, the employer representative will present a closing statement. The closing statement is an opportunity to reiterate the facts presented throughout the arbitration. This is the final plea from the employer's side

UNION CLOSING STATEMENT

After the employer's closing statement, the employee's side will present their closing statement. The closing statement is an opportunity to reiterate the facts presented throughout the arbitration and re-suggest disciplinary action for the employee. This is the final step before the arbitrator presents their decision.
